Official Rules
1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. ALL U.S. FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. HOW TO ENTER: The Contest will begin on or about March 25, 2013 and end on or about April 12, 2013 (the "Contest Period") To enter, tune in to 95.1 WAPE ("95.1 WAPE") weekdays (Monday through Friday) between 5-10am during the Contest Period and listen for the Universal cue to call. Be the first caller at 340-9595 or 1-800-475-9595 to correctly answer the day's trivia question. Subject to confirmation of your eligibility and compliance with these Official Rules; Sponsor will not be responsible for loss of service to any Contest telephone line or for a contestant's failure to reach any Contest line due to malfunction of any network or system, congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call
3. ELIGIBILITY: The "Mardi Gras – Universal Orlando" contest is open only to Florida/Georgia residents who are 18 years of age or older at the time of entry and who have not won any other on-air or on-line contest from WAPE-FM or WAPE.com in the past 30 days. Employees of Cox Enterprises, Inc., Cox Radio, Inc., any other radio stations, promotional sponsors, and all affiliated companies (and the immediate family members of all such employees, and all other with whom they are domiciled) are not eligible to participate in the contest or win the prize. The term, immediate families include spouses, grandparents, siblings, children, and grandchildren.
4. PRIZES: One (1) grand prize winner will receive hotel accommodations room and tax only, for up to four (4) people in a maximum of one (1) room at a hotel selected by Universal Orlando for one (1) night, plus four (4) 1-day/2-park tickets to Universal Studios and Islands of Adventure theme park and one (1) complimentary Universal Orlando General Parking Pass valid through May 19, 2013. ARV: $566.50. Twenty five (25) Secondary prizes: Two (2) 1-Day/2-Park Universal Orlando tickets valid for admission to Universal Studios and Islands of Adventure theme parks valid through May 19, 2013. One (1) Universal Orlando general parking pass, valid through May 19, 2013. ARV: $255.00 Winner shall be notified via email and/or phone and must pickup their prize within 10 business days of notification or before close of business on date of ticketed event at 8000 Belfort Parkway, Jacksonville, FL. If the prize is not claimed by that time, it will be forfeit and Cox Radio shall not bear any responsibility for failure of Winner to provide verification of their eligibility by that deadline. Blackout dates or other restrictions may apply. Winner travel arrangements must be made a minimum of fourteen (14) days prior to winner travel and are subject to availability. Hotel stay, theme park, and hard ticket dates may not be changed after scheduling, acceptance, and confirmation by UO. All elements of each Grand Prize package must be used, redeemed, fulfilled, booked and/or confirmed at the same time, and no changes will be permitted. If winner is unable to fulfill any portion of the prize during the time period specified, winner forfeits the entire prize package. Winner and guests must travel at the same time. Prizes are non-transferable and have no cash value. All unclaimed and/or unused prize packages, including theme park tickets, will remain the property of UO and may not be used as sales or trade incentive for employees of the Sponsor, and may not be sold, exchanged or otherwise transferred by winner, nor used by the Sponsor, its agencies or clients. All tickets are valid during normal operating hours only. Operating hours and availability of attractions and shows are subject to change without notice. Some special events may be separately ticketed. UO reserves the right to change the name of all tickets. All tickets specifically exclude admission to special or separately ticketed "hard ticket" entertainment events at either of the theme parks or within any of the Universal CityWalk venues.
5. ODDS: Each weekday during the contest period, sponsor will select at least one (1) winner who will win the secondary prize. On or about 4/12 sponsor will select one (1) secondary prize winner at random and they will be declared the Grand Prize winner. The odds of winning a secondary prize depends on the number of qualified entries submitted by people attempting to participate in the contest at any given time. The odds of a secondary prize winner winning the Grand Prize is 1/25.
6. WINNER NOTIFICATION AND ACCEPTANCE: The Prize is non-assignable and non-transferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and WAPE-FM reserves the right to substitute prizes of equal or greater value. Some elements of the prize are not available for general purchase and therefore have no value. The Winner is solely responsible for the reporting and payment of any taxes on prizes. As a condition of receiving the contest prize, the Winner will be required to complete an affidavit of eligibility and a liability and publicity release, which must be signed at the time the winner claims his/her prize at the WAPE-FM Business Office. Grand prize winner's name and contact info will be shared with Universal Orlando who will be finalizing travel arrangements. Failure of to sign the affidavit or release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of WAPE-FM, and Cox Radio, Inc., result in winner's disqualification, the forfeiture of his or her interest in the prize. Except where prohibited, participation in the Contest constitutes the Winner's consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from WAPE-FM, and Cox Radio, and on the Cox Radio Interactive Web sites, and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation. 7. PARTICIPATION: Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules. WAPE-FM, and Cox Radio, Inc. reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest. WAPE-FM reserves the right to alter, modify, or cancel the contest at any time for any reason.
8. LIMITATIONS OF LIABILITY: By entering the Contest, contestant agrees that (1) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and (3) under no circumstances will any contestant be permitted to obtain any award for, and contestant hereby waives all rights to claim punitive, incidental or consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
9. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the contestant and Cox Radio, Inc. in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Florida. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
10. GENERAL RELEASE: By entering the Contest, contestants release WAPE-FM, Cox Radio, any other promotional sponsors, and each of their respective parents, affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).
11. The "Mardi Gras – Universal Orlando" contest is sponsored by WAPE-FM, Cox Radio, Inc., whose decisions regarding the selection of winners and all other aspects of Contest shall be final and binding in all respects. WAPE-FM, and/or Cox Radio, Inc., will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Contest materials.
