Florida man shows assault rifle during parking dispute, police say

CLEARWATER, Fla. — A Florida man is accused of wielding an assault rifle and threatening another person over a parking dispute last month, authorities said.

David Hector Berry, 44, of Clearwater, was arrested Friday and charged with aggravated assault, a third-degree felony, the Clearwater Police Department said in a news release.

He was booked into the Pinellas County Jail on Friday night and was released after posting $5,000 bail, according to Pinellas County Sheriff’s Office online booking records.

According to a witness affidavit, a landscaper was working on a lawn on July 7 when Berry came out of his home and yelled because an equipment trailer was blocking his driveway, the Tampa Bay Times reported. Police said Berry then went to his truck and retrieved an assault rifle, pointing it at the man “in a threatening manner,” according to the newspaper.

Jeremy Lee moved his vehicle up, but that did not satisfy Berry, WFLA-TV reported.

Lee’s daughter recorded a video of the incident, according to the affidavit.

“This is my property. I would’ve shot you dead and you would’ve went to jail,” Berry can be heard in the video, according to WFLA.

In late July, Berry’s weapons were seized by the Clearwater Police Department and the sheriff’s office through a risk protection order, the Times reported.

“If the suspect had a problem with how someone was parking, he should have called the police and let us handle it,” Clearwater police Chief Dan Slaughter said in a statement. “You don’t arm yourself with an assault rifle and threaten someone over something so trivial.”
